GENERAL
1. By entering the Win Property competition, a competitor is deemed to have read and accepted these Terms and Conditions and agrees to be bound by them;
2. The Win Property competition is operated by the Promoter.
3. The Win Property competition is open to all persons aged 18 or over, but excluding the Promoter, their family, their agents, employees, advisers or anyone connected with the development or operation of the competition in any way;
4. As a condition of entering the Win Property competition, a competitor must ensure that entering the competition does not breach any laws of the competitor’s country of residence. The Promoter will not be liable in any way if a competitor enters a competition unlawfully;
5. The Win Property competition is a skill competition which is legal in the UK on the basis of UK gaming/gambling law. Success in the Win Property competition depends to a substantial degree on the exercise of skill;
6. The Win Property competition is governed by English law and in the event of any dispute the courts of England shall have exclusive jurisdiction;
7. The Valuation has been provided by the Promoter in comparison with the value of similar properties in the vicinity of the Property.
THE WIN PROPERTY PRIZE
8. The competition is to win the Property or a cash alternative (“the Prize Fund”) as stated below;
9. Further detail about title to the Property is shown on the competition website;
10. In the event that the prize is the Property, the Property will be transferred to the winner of the competition free of all mortgages and other charges by the Promoter, at the Promoter’s expense and including all fees, charges and taxes;
11. Where the prize is the Property, the Promoter shall ensure (so far as it is able to do so, but without liability) that the Property is registered at HM Land Registry in the winner’s name;
12. If the prize is the Property, no cash alternative will be offered;
13. Monetary payments will only be accepted and paid out in pounds sterling;
THE WIN PROPERTY COMPETITION
14. On the Win Property competition homepage, the competitor must select the “play” button. The competitor will then be directed to a screen containing details about the competition and the Property. A screen will show a scene from a rugby match, from which the position of the ball has been electronically removed. Using skill and the information contained in the photograph, the competitor must exercise skill and judgement to select a grid reference where the competitor considers that the Judge will select as the centre of the ball once the competition has closed;
15. Once a spot has been chosen by a competitor, he/she must click on the spot using the mouse on their computer;
16. The chosen spot will be identified by reference to the grid and the computer will register the grid reference of the spot chosen as a competitor’s entry into the competition;
17. To conclude an entry into the competition, a competitor will then be asked to provide their contact details (including postal and e-mail addresses and a telephone number) and card payment details. Once the entry is submitted, the competitor’s card payment will be electronically approved. Entry to the competition will only be confirmed on approval of the payment and by the sending of an e-mail by the Promoter to the competitor confirming entry into the competition. The e-mail will confirm the co-ordinates of the chosen spot, the date and time of entry and the Prize;
18. When the number of entries stated above or the closing date is reached, the competition will close;
19. The Judge will then use his/her knowledge to determine where he/she believes that the centre of the ball is. This determination will take place in the presence of a lawyer and the Promoter’s representative. The co-ordinates of the spot selected by the Judge will be determined electronically;
20. The Promoter and the Judge will determine electronically which (if any) of the competition entries matches the co-ordinates chosen by the Judge;
21. (Subject to clause 27) The winner of the Property will be the competitor who selected the co-ordinate which was determined by the Judge as the co-ordinate of the centre of the ball. If no competitor selected the winning co-ordinate, then the winner will be the competitor who selected the co-ordinate nearest to the winning co-ordinate (as determined by the Judge at his/her sole discretion);
22. (subject to clause 27) If there is more than one competitor who selected the winning co-ordinate or if more than one competitor selected the spot equally near to the winning co-ordinate, then a cash alternative equal to the Valuation will be shared equally by the winning competitors;
23. The Judge’s decision is final and no correspondence will be entered into about the result of a competition following the determination of the winner(s);
24. The winner(s) of the competition will be notified by post, e-mail or telephone within 20 days of the competition closing date;
25. The winner(s) will be required to forward a copy of their passport to the Promoter to prove their identity and may also be required to prove that entry into the competition was made using a valid debit/credit card belonging to the entrant or with the authorisation of the card holder. The winner (where the prize is the Property) will be required to sign a transfer deed to transfer the Property into the winner’s name. Where the prize is the Property, the winner will be required to have the Property registered at HM Land Registry in the winner’s name;
26. If the winner cannot be found by the Promoter within 30 days of being notified of the win by e-mail, telephone and mail to the telephone number/e-mail address/postal address given in his entry, the Promoter shall be entitled to award the Prize to the competitor or competitors with the next nearest co-ordinates to the centre of the ball;
27. If the winner does not claim the Prize within 30 days (as stated above) his loses the right to claim the Prize;
CLOSING OF THE WIN PROPERTY COMPETITION
28. If the number of entries to the Win Property competition stated above have not been made as at the closing date, the competition will close and the proceeds of the competition will be determined using the formula “number of tickets sold x ticket price” (“the Entry Fees”);
29. The winner(s) of the Win Property competition will then be determined in accordance with clauses 18-21 above;
30. The Promoter will be entitled to retain 25% of the Entry Fees, to cover administration and marketing expenditure. The remaining balance following deduction of the 25% is “the Prize Fund”. The Prize Fund or an amount equal to the Valuation (whichever is the lowest in value) will then be distributed to the winning competitor(s) (in equal shares if there is more than one) as stated above;
OTHER ISSUES
31. All Entry Fees will be maintained in a separate bank account by the Promoter until the winner(s) of the competition has been determined;
32. The winner(s) agrees to allow the Promoter to use his/her name and photograph on all promotional material and on the Win Property competition website;
33. The winning competitor will permit his details to be used in any promotional activity undertaken by the Promoters and details may be published on the website at www.win-property.co.uk;
34. Competitors authorise the Promoter to enter the competitors personal details into its database and to use the information in any legal way;
35. The Promoter reserves the right to cancel the competition at any time either before or after tickets have been sold. If a competition is cancelled, the Promoter will either transfer the customer’s entry to another competition run by the Promoter or will return the entry fee to each competitor (either by bank card refund or by cheque and in one combined payment where several entries have been made by a competitor). Where the entry fee is returned, the Promoter shall have no further liability to the competitor nor to any other person;
36. The Promoter reserves the right to extend the closing date by up to 2 months at its disrection.
37. The Promoter makes no representation or warranty about the Property, the Valuation, its structural or cosmetic condition or its saleability and competitors should make and rely on their own enquiries about the Property before entering the competition. Insofar as it is lawful to exclude liability, the Promoter will not be liable for any loss (including economic loss) suffered to or sustained by any person or property as a result of any act or omission of the Promoter, nor will its servants or its agents in developing, planning and running the competition, distributing the prize to the winner or following the distribution of the Prize;
38. The Promoter will not be liable for any loss suffered by a competitor as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the company’s website.

How many tickets are there for each Win a Property competition? A maximum of 10,000.
How long is the Win a Property competition open for? A maximum of 52 weeks.
How are the competitions judged? Each Win Property competition is judged by an independent, qualified referee and witnessed by solicitor and a director of the WinProperty.
What happens if you don’t sell all of the tickets? If the Win Property competition closes and we haven’t sold all of the tickets, the winner will receive the total of money raised through ticket sales minus a fee of 25% to cover marketing and administration costs.
How will I know if I’ve won a property? We’ll let you know by email and post within two weeks of the Win Property competition closing date.
